Inspired and derivative works from the copyright perspective

Niniejsza praca magisterska skupia się na tematyce utworu inspirowanego oraz utworu zależnego z perspektywy prawa autorskiego. W celu całościowej analizy przedstawionego zagadnienia omówione zostały w niej chronione i niechronione elementy utworu, definicje wskazanych utworów (z perspektywy obowiązujących przepisów, orzecznictwa oraz poglądów doktryny) oraz ich szczegółowa charakterystyka. Został również zasygnalizowany i omówiony problem ich odróżniania, na przykładzie różnic identyfikujących utwór jako inspirowany lub zależny.

This master's thesis focuses on the subject of an inspired work and a derivative work from the copyright perspective. For the purpose of a comprehensive analysis of the presented issue, it discusses the protected and unprotected elements of the work, the definitions of the indicated works (from the perspective of applicable regulations, jurisprudence and doctrine views) and their detailed characteristics. The problem of distinguishing them was also signaled and discussed, based on the example of differences identifying a work as inspired or derivative.
