The limits of freedom of artistic creativity in the penal code

Praca porusza problematykę wolności twórczości artystycznej w kontekście odpowiedzialności karnej artystów za realizację znamion różnych typów czynów zabronionych. W pracy dokonano analizy wolności twórczości artystycznej na gruncie Konstytucji oraz pojęcia "twórczości". Ponadto przedstawiono jak mogą przebiegać konflikty na gruncie tej wolności z przepisami dotyczącymi ochrony życia i zdrowia, wolności sumienia i wyznania, wolności seksualnej i obyczajności oraz mienia. Ostatni rozdział porusza problematykę "kontratypu sztuki", gdzie przedstawiono istniejące koncepcje dotyczące tego kontratypu oraz przytoczono argumenty przemawiające za ich odrzuceniem.

The master thesis deals with the issue of the freedom of artistic creation in the context of criminal liability of artists for the implementation of the hallmarks of various types of prohibited acts. The master thesis analyzes the freedom of artistic creation on the basis of the Constitution and the concept of "creativity". In addition, it shows how conflicts can arise on this freedom with the provisions on the protection of life and health, freedom of conscience and religion, sexual freedom and decency and property. The last chapter deals with the issue of "counter-artistic art", where the existing concepts of this counter-article are presented, and the arguments for rejecting them were quoted.
