For artists design is a way of living in which they can develop their creative potential. Additionally, design helps in building a company’s image by producing unique products which by their appearance draw the attention of many consumers. The thesis deals with the problem of the effectiveness of the protection and registration of the industrial design on the example of a dispute in the case Trunki vs Kiddee. Kiddee has created an identical mobile suitcase for children as children’s suitcases producer Trunki, who finally lost the Supreme Court battle, despite the fact that they had registered the industrial design first. Supreme Court has claimed that Kiddee has not infringed the Trunki industrial design because the shape of the case and other features were not the same.
