Public prosecutor's participation in the administrative proceeding

Niniejsza praca magisterska ma na celu opisanie i wyjaśnienie na czym polega udział prokuratora w postępowaniu administracyjnym. Podjęcie tego tematu wymaga spojrzenia na to zagadnienie zarówno w perspektywie historycznej, jak i teraźniejszej. W pracy tej omawiane są pojęcia prokuratora oraz prokuratury. Ukazane one są zarówno w pierwotnym, jak i obecnym brzmieniu Kodeksu postępowania administracyjnego, a także w perspektywie przepisów regulaminowych i ustawowych odnoszących się do prokuratora i prokuratury. Dla lepszego zrozumienia tematu omówione zostaje postępowanie administracyjne, w tym rodzaje postępowań. Wskazane zostają pojęcia strony i podmiotu na prawach strony w postępowaniu administracyjnym z uwzględnieniem legitymacji prokuratora do udziału w postępowaniu administracyjnym, a także uprawnień, które z takim udziałem się wiążą. Prokurator omawiany jest w kontekście dwóch form udziału w postępowaniu administracyjnym - na etapie możliwości żądania przez niego wszczęcia postępowania, jak i dopuszczenia go do toczącego się już postępowania. This master's work is intended to describe and explain on what the public prosecutor's participation in the administrative proceeding is based. Approaching this topic requires viewing the issue from both a historical and present-day perspective. In this work, the terms public prosecutor and public prosecution service are discussed. They are shown both in the original and current wording of the Code of Administrative Procedure, as well as in the perspective of regulations and legislation relating to the public prosecutor and the public prosecution service. For a better understanding of the subject, administrative proceeding is discussed, including the types of proceedings. The terms of the party and entity with the rights of the party in administrative proceeding are indicated, with consideration of the legitimacy of the public prosecutor to participate in administrative proceedings, as well as the entitlements that such participation implies. The prosecutor is discussed in the context of two forms of participation in administrative proceeding - at the stage of the public prosecutor's capacity to request the initiation of proceedings, as well as admission to the proceeding already in progress. A significant element of the work is the discussion of the issue of the public prosecutor's objection.
