Ius moderandi in civil proceedings after amendments introduced by the Act of 4 July 2019 amending the Act – Code of Civil Procedure and some other acts

Artykuł stanowi przekrojową analizę zmian w procedurze cywilnej wprowadzonych na mocy ustawy z 4.07.2019 r. o zmianie ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw (Dz.U. poz. 1469), które wpływają na zakres kompetencji sądu do dokonania ustaleń faktycznych oraz rozstrzygnięcia o żądaniu pozwu w oparciu o sędziowskie uznanie, określanej zwyczajowo w doktrynie i orzecznictwie mianem ius moderandi. W opracowaniu autor poddaje ocenie rozszerzenie zakresu zastosowania ius moderandi w postępowaniu zwykłym na mocy art. 322 k.p.c. w nowym brzmieniu oraz powiązane z tą ogólną regulacją, szczególne unormowania wprowadzone w postępowaniu uproszczonym (art. 5057 k.p.c.) oraz postępowaniu w sprawach gospodarczych (art. 4589 k.p.c.).

The article includes a comprehensive analysis of amendments of the civil procedure introduced pursuant to the Act of 4 July 2019 on the amendment of the Act – Code of Civil Procedure (CCP) and certain other acts (Journal of Laws of 2019, item 1469) that affect the scope of the court’s competence to establish pertinent facts of the case and decide on a claim on the basis of judicial discretion, which in jurisdprudence is also referred to as the so-called ius moderandi. In the paper, the author examines the extension of the scope of application of ius moderandi in ordinary proceedings pursuant to the Article 322 of the CCP, as amended, as well as two more specific regulations of similar nature which have been introduced in simplified proceedings (Article 5057 CCP) and separate proceedings in commercial matters (Article 4589 sect. 7 CCP).
