The penitentiary supervision in terms of doctrinal, normative and functional

Niniejsze opracowanie przedstawia nadzór penitencjarny jako instytucję o charakterze nadzorczo-kontrolnym w postępowaniu wykonawczym. Analizę rozpoczęto od procesu kształtowania się instytucji nadzoru penitencjarnego, począwszy od nadzoru prokuratorskiego po współczesną regulację sędziowskiego nadzoru penitencjarnego. W drugim rozdziale pracy zostały przedstawione aksjologiczne podstawy tej instytucji oraz cele jakie ma pełnić. Ponadto, określono charakter prawny sędziowskiego nadzoru penitencjarnego oraz jego zakres. Kolejny rozdział dotyczy rozgraniczenia kompetencji sądu penitencjarnego od kompetencji sędziego penitencjarnego jako niezależnego organu postępowania wykonawczego. Rozważania kończy rozdział poświęcony analizie badań, które przedstawiają funkcjonowanie sędziowskiego nadzoru penitencjarnego w praktyce.

This paper presents the penitentiary supervision as a supervisory and controlling institution in enforcement proceedings. The analysis began with the formation process of penitentiary institutions, starting with the supervision of the prosecution to the modern regulation of the judges of penitentiary supervision. In the second chapter, axiological foundations of the institution and the goals it should act are presented. In addition, the legal nature of the judge penitentiary and its scope were defined. The next chapter concerns the delimitation of the competences of the penitentiary court and the competences of the penitentiary judge as an independent organ of executive proceedings. The paper ends with a chapter devoted to the analysis of research that shows the functioning of the judges of penitentiary supervision in practice.
