The Legal Status of Minors in Polish Inheritance Law

Praca przedstawia sytuacje osób małoletnich w procesie dziedziczenia, omawia prawa i obowiązki opiekunów prawnych oraz formy ochrony małoletnich. W pracy wyjaśnione zostały podstawowe pojęcia z zakresu prawa spadkowego, istotne dla zrozumienia sytuacji osób małoletnich, takie jak spadek, moment otwarcia spadku, zdolność dziedziczenia. Omówione zostały również rodzaje dziedziczenia z wyszczególnieniem instytucji zachowku, a także prawa i obowiązki dziedziczących. Następnie szczegółowo opisano możliwości przyjęcia i odrzucenia spadku w imieniu osoby małoletniej z uwzględnieniem problemów mogących pojawiać się w trakcie procesu dziedziczenia, a także uprawnienia i obowiązki reprezentanta osoby małoletniej dotyczące spadku. Zwrócono uwagę na możliwość odrzucenia spadku w imieniu osoby małoletniej bez zgody sądu opiekuńczego, która wprowadzona została w 2023 roku i wyjaśniono w jakiej sytuacji może być stosowana. Przeanalizowano jak chroniony jest małoletni w prawie spadkowym i na kim ciążą obowiązki zadbania o najlepszy interes młodych spadkobierców. Rola rodziców sądu a także notariusza została opisana pod względem obowiązków prawnych i tego jak dane podmioty mogą chronić małoletnich przed niekorzystnymi skutkami prawnymi.

The thesis presents the situation of minors in the inheritance process, discusses the rights and duties of legal guardians, and the forms of protection for minors. The work explains basic concepts in the field of inheritance law, essential for understanding the situation of minors, such as inheritance, the moment of opening the inheritance, and the capacity to inherit. The types of inheritance are also discussed with a detailed explanation of the institution of the compulsory portion, as well as the rights and duties of heirs. Subsequently, it describes in detail the possibilities of accepting or rejecting an inheritance on behalf of a minor, considering potential problems that may arise during the inheritance process, as well as the rights and duties of the minor's representative regarding the inheritance. Attention is drawn to the possibility of rejecting an inheritance on behalf of a minor without the consent of the guardianship court, which was introduced in 2023, and explains in which situations it may be applied. It analyzes how minors are protected under inheritance law and on whom the responsibilities lie to ensure the best interests of young heirs. The roles of parents, the court, and the notary are described in terms of legal obligations and how these entities can protect minors from unfavorable legal consequences
