Appeal in administrative proceedings

Tematem pracy jest odwołanie w postępowaniu administracyjnym. Praca ma na celu przedstawienie kształtu oraz funkcji tego środka prawnego w świetle przepisów k.p.a. Opracowanie składa się z czterech rozdziałów. W pierwszym rozdziale omówiono pojęcie odwołania jako środka prawnego na gruncie regulacji k.p.a., a także literatury i orzecznictwa. Drugi rozdział poświęcono problematyce postępowania odwoławczego. W trzecim rozdziale poruszono problematykę praktyczną odwołania oraz dokonano analizy wybranych zagadnień szczegółowych związanych z tym środkiem zaskarżenia. W ostatnim rozdziale scharakteryzowano odwołanie na tle zwyczajnych środków zaskarżenia – zażalenia oraz wniosku o ponowne rozpatrzenie sprawy.

The subject of the study is the appeal in administrative proceedings. The aim of the work is to present the structure and function of this legal procedure in the light of the provisions of the Code of Administrative Procedure. The study consists of four chapters. The first chapter discusses the concept of appeal as a legal procedure in the light of the provisions of the Code of Administrative Procedure, as well as literature and jurisprudence. The second chapter was devoted to the problem of appeal proceedings. The third chapter deals with the practical problems of the appeal and analyses selected specific issues related to this legal remedy. The last chapter characterises the appeal against the background of ordinary means of appeal - a complaint and a motion for reconsideration of the case.
