Social security case as the subject matter of civil proceedings

Zadaniem niniejszej pracy jest przeprowadzenie analizy natury spraw z zakresu ubezpieczeń społecznych jako przedmiotu rozpatrywanego przez polskie sądy według norm procedury cywilnej. Spornym jest jednak, czy wspomniane sprawy są rzeczywiście cywilne ze swej natury. Niektórzy bowiem przedstawiciele doktryny wskazują na występujące w przedmiotowych sprawach elementy charakterystyczne dla prawa administracyjnego. Tym samym, w celu dookreślenia natury badanych spraw, analizie poddane zostają nie tylko normy proceduralne stosowane przez sądy pracy i ubezpieczeń społecznych w przedmiotowych sprawach, ale także normy prawa materialnego regulujące stosunki ubezpieczenia społecznego. Poruszane są także funkcjonalne aspekty przekazania spraw z zakresu ubezpieczeń społecznych właściwości sądów powszechnych.

The purpose of this work is to analyze the issue of the nature of cases of social insurance as the subject matter of review of Polish courts according to the rules of civil procedure. However, it is still a matter of dispute whether the cases reviewed are civil in nature. The problem is, some scholars believe the said cases to show features that are usually attributed to cases that are governed by administrative law. Therefore, to determine the nature of the cases reviewed by the courts of labour and social security, this work looks not only into the procedure applied by these courts but also into the law governing the relations of social security itself. In addition, the work touches the functional aspect of supplying general courts with jurisdiction over social security cases.
