The system of sources of law in the Constitution of the Republic of Poland

Niniejsza praca przedstawia omówienie katalogu źródeł prawa funkcjonującego w polskim prawodawstwie. Zaprezentowano cechy systemu źródeł prawa i podstawowe jego problemy. Rozwinięto problem zamknięcia systemu źródeł prawa a także znaczenie orzeczeń Trybunału Konstytucyjnego na tle tegoż zamknięcia. W dalszej części pracy omówiono pozycję Konstytucji i jej naczelne zasady. Podkreślono również znaczenie wstępu jako kluczowego składnika Konstytucji. Następnie przedstawiono pozycję ustawy w systemie i omówiono jej cechy. Dokonano analizy procedury ustawodawczej począwszy od zgłoszenia projektu do ogłoszenia ustawy. Kolejna część pracy została poświęcona rozporządzeniu jako aktowi wykonawczemu do ustawy. Przedstawiono cechy tego źródła prawa a także podmioty uprawnione do jego wydawania. Następnie poruszono kwestię umowy międzynarodowej jako składnika systemu źródeł prawa. Ostatnia część pracy dotyczy aktów prawa miejscowego. Przedstawiono typy aktów oraz ich cechy a także pozycję ustrojową.

This thesis presents a discussion of the sources of law functioning in Polish legislation. There are presented features of the system of sources of law and its basic problems. The problem of closing the system of sources of law is developed and the importance of judgments of the Constitutional Court. Further, the position of the Constitution and its main principles are discussed. The importance of introduction to the Constitution is also emphasized. In the next part, the Act and its features are discussed. The analysis of the legislative process from the submission of the project to the publication of the Act is presented. Next part of the thesis is devoted to the regulation as an implementing act. Following part presents features of this source and entities entitled to issue the regulation. Further, the international agreement as a component of the system of sources of law is developed. The last part of this thesis concerns local law. The types of acts and their features are discussed as well as the position in the system.
