The principle of judicial impartiality

Przedmiotem tej pracy jest zasada bezstronności jako gwarancja sprawiedliwości. Jest to jednocześnie zasada obowiązująca w państwach demokratycznych. W pracy omówiłam równocześnie pojęcie niezawisłości jako obowiązek, który stoi przed sędzią. Oba przymioty bezstronności i niezawisłości są efektem istnienia niezależnego sadownictwa, które jest gwarantowane przestrzeganiem zasady podziału władz. Omówiłam również zasadę bezstronności jako wynik przysługującego każdemu prawa do sądu i prawa do rozstrzygnięcia sprawy przez bezstronny i niezawisły sąd. Omówiony w pracy problem instytucji wyłączenia sędziego jest praktyczną gwarancją przestrzegania przymiotów bezstronności i niezawisłości. Przymioty bezstronności i niezawisłości są podstawą budowania zaufania społeczeństwa do sądów i sądownictwa.

The subject matter of this thesis is the impartiality as the pledge of justice. It’s simultaneously the rule of law in a democratic state. In the thesis I also discussed the judicial independence which is the duty of the judge. Both of these principles are the result of the judicial autonomy which is ensured by the principle of separation of powers. I also discussed the matter of impartiality as the outcome of the right to a fair trial and the right to impartial judicial proceedings. I also covered the issue of exclusion of a judge as a practical guarantee that the principles of impartiality and the judicial independence are respected. Impartiality and the judicial independence are the basis when it comes to building the public’s trust in the court system and judicature as a whole.
