Set-off defence in civil proceedings

Tematem niniejszej pracy jest problematyka zarzutu potrącenia w procesie cywilnym. W pierwszym rozdziale dokonano analizy środków obrony pozwanego ze szczególnym uwzględnieniem zarzutów. Rozdział drugi został w całości poświęcony zagadnieniu relacji zarzutu potrącenia w prawie cywilnym procesowym względem potrącenia w prawie cywilnym materialnym. W rozdziale trzecim omówiono funkcję zarzutu potrącenia w procesie cywilnym, dokonując oceny, czy zarzut potrącenia jest jedynie środkiem obrony, czy także środkiem dochodzenia roszczeń. Przedmiotem ostatniego (czwartego) rozdziału jest analiza regulacji zarzutu potrącenia zawartej w Kodeksie postępowania cywilnego oraz związanej z nią problematyki powództwa wzajemnego i powództwa opozycyjnego. W podsumowaniu pracy przedstawiono ocenę obecnego stanu prawnego oraz postulaty de lege ferenda, odnosząc się do założeń projektu nowelizacji opracowanego przez Komisję Kodyfikacyjną Prawa Cywilnego.

The subject of this thesis is the set-off defence in civil proceedings. The first chapter includes an analysis of the means of defence available to the defendant, with particular emphasis on defendant’s objections. The second chapter is devoted to the relationship between the set-off defence in civil proceedings and the institution of set-off in substantive civil law. The third chapter provides an examination of the function of the set-off defence in civil proceedings, with particular focus on whether it serves merely as a means of defence or also as a means of pursuing a claim. The subject of the last (fourth) chapter is an analysis of the regulation of the set-off defence contained in the Code of Civil Procedure and the related issues of counter-claim and counter-execution action. The summary includes an assessment of the current legal framework and de lege ferenda proposals with reference to the amendment drafted by the Civil Law Codification Commission.
