Psychosocial conditions and consequences of unequal access to medically assisted procreation in Poland in the light of EU regulations

Artykuł podejmuje kwestię dostępu do medycznie wspomaganej prokreacji w Polsce w kontekście jej psychospołecznych uwarunkowań i skutków. Autorka artykułu wśród najważniejszych uwarunkowań wymienia: regulacje prawne harmonizujące prawo polskie i unijne, społeczny postulat równości w dostępie do dystrybuowanych dóbr i świadczeń społecznych, oczekiwania par starających się o dziecko i cierpiących z powodu niepłodności. W wyniku analizy tych trzech fundamentalnych uwarunkowań autorka stwierdza, że największy i najbardziej znaczący wpływ spośród analizowanych uwarunkowań ma kwestia równości dostępu do świadczeń, a właściwie jej braku. Stawia ponadto tezę, że powszechny dostęp obywateli do pomocy państwa w korzystaniu z medycznie wspomaganej prokreacji niesie korzystne skutki zarówno dla państwa, jak i dla jego obywateli (w wymiarze demograficznym, gospodarczym, emerytalnym i społecznym). Zapewnianie i promowanie równości w dostępie obywateli do medycznie wspomaganej prokreacji jest wyzwaniem dla rozwoju społeczeństwa demokratycznego państwa prawa.

The article deals with the issue of access to medically assisted procreation in Poland in the context of its psychosocial conditions and the effects it brings. The author of the article lists among the most important conditions: legal regulations harmonizing Polish and European Union law; social demand for equality in access to distributed social goods and benefits; expectations of couples applying for a child and suffering from infertility. As a result of the analysis of these three fundamental conditions, the author states that the biggest and most significant influence among the analyzed conditions is the issue of equal access to benefits - or actually its lack. The author also puts forward the thesis that the universal access of citizens to state aid in the use of medically assisted procreation has beneficial effects both for the state and its citizens (in the demographic, economic, pension and social dimensions). Ensuring and promoting citizens equality in the access to medically assisted procreation is a challenge desirable for the development of a democratic society in the state of law.
