Institutional and legal problems related to migration and refugees

Unia Europejska gwarantuje swobodny przepływ osób, towarów, usług oraz kapitału. Pierwszy z nich związany jest z problemem migracji, kontroli granicznych czy też instytucji azylu. Duże znaczenie ma również strefa Schengen, czyli porozumienie znoszące kontrolę osób przekraczających granice państw. Do monitorowania przepływu migracji zostały powołane specjalne organy takie jak SIS, Frontex, EUROSUR, EURODAC, EASO i EFU. Ogromne znaczenie odgrywają także działania organów międzynarodowych czy Unii Europejskiej. Wszystkie z nich zajmują się problemem uchodźców, kwestią ich przyjmowania, pomocy oraz zamachów terrorystycznych. Do wielu z nich doszło w 2016 i 2017 roku w europejskich miastach, co szeroko komentowały media. Mimo to wciąż brakuje jednolitego rozwiązania, co zrobić wobec powyższej sytuacji. Celem niniejszej pracy jest wskazanie, że pomimo dużej ilości powołanych instytucji oraz aktów prawnych, wciąż brakuje nowych uregulowań i jednoznacznych decyzji wobec ostatnich wydarzeń.

The European Union guarantees the free movement of people, goods, services, and capital. The first of these freedoms is connected with the problem of migration, border controls and the institution of asylum. An important part is also played by the Schengen zone, which is an agreement abolishing the control of people crossing national borders. To monitor the migration flows, specialized organisations have been appointed, including SIS, Frontex, EUROSUR, EURODAC, EASO and EFU. What is more, the activities of international bodies of the European Union have also a great impact here. All of them deal with the problem of refugees, the issue of their reception and assistance as well as terrorist attacks. A lot of such attacks occurred in 2016 and 2017 in European cities, which was widely commented by the media. Despite these measures, there is still a lack of a single solution to the above situation. The purpose of this article is to show that, despite a large number of established institutions and legal acts, there is still a lack of new regulations and unambiguous decisions regarding recent events.
