The selected problems of the question of law institution to the Polish Constitutional Court.

Niniejsza praca magisterska stanowi analizę instytucji pytań prawnych do Trybunału Konstytucyjnego. Celem pracy była odpowiedź na pytanie, czy instytucja ta w obecnym kształcie spełnia swoją rolę, jaka została jej nadana przepisami Konstytucji. W pierwszym rozdziale został omówiony kształt, oraz miejsce jakie Trybunał Konstytucyjny zajmuje w krajowym porządku prawnym. Następnie omówiono podstawową funkcję Trybunału Konstytucyjnego, jaką jest kontrola konstytucyjności prawa, oraz wskazano, że jednym ze sposobów inicjacji tej kontroli jest złożenie pytania prawnego.W następnych rozdziałach zostały wskazane podmioty legitymowanego złożenia pytania prawnego, oraz sytuacje, które umożliwiają, lub nie umożliwiają złożenie takiego pytania. Rozważania te stanowiły punkt wyjścia do kolejnych rozdziałów, w których jest omawiana przesłanka przedmiotowa, oraz funkcjonalna pytania prawnego. W ostatnich rozdziałach omówione zostało postępowanie przed Trybunałem Konstytucyjnym w sprawach zainicjowanym pytaniem prawnym, oraz wpływ tego postępowania na postępowanie sądowe, łącznie z uwzględnieniem orzeczeń wydawanych przez Trybunał Konstytucyjny w sprawie pytania prawnego.

The present thesis provides an analysis about question of law to the Polish Constitutional Court. The main aim of the thesis is to address the question whether the present shape of this institution fulfills its role which is included in the Constitution. The first chapter discusses the shape and the place which the Constitutional Court has in the domestic legal order. Then, the basic function of the Constitutional Court was discussed which is the constitutional control over the law and it was pointed out that one of the ways to initiate this function is the submission of a question of law.The following chapters presents the entities that are entitled to submit a question of law to the Constitutional Court, as well as, the situations in which the submission of a legal question is allowed or not. These considerations constitute the point of departure of the following chapters in which the objective and functional precondition of the question of law is discussed. The last chapters examines the proceedings before the Constitutional Court in the cases which were brought by the legal question and the influence of the present proceedings on court proceedings including the rulings issued by the Constitutional Court in the question of law cases.
