Criminal responsibility for the content of the deposition versus the realisation of material truth

Celem niniejszej pracy magisterskiej jest dokonanie analizy przepisów penalizujących fałszywe depozycje, zawartych przede wszystkim w art. 233 Kodeksu karnego, w świetle ich przydatności dla poszukiwania prawdy o zdarzeniu przestępnym w postępowaniu karnym. Uznając zasadę prawdy materialnej za najważniejszą dyrektywę procesu karnego, autor pragnie zwrócić uwagę na zależności, jakie zachodzą pomiędzy dążeniem organów procesowych do realizacji wspomnianej powyżej zasady a przestępstwami przeciwko wymiarowi sprawiedliwości - zwłaszcza fałszywymi zeznaniami. W przedmiotowej pracy przedstawione zostały, pojawiające się zarówno w doktrynie prawa karnego, jak i w orzecznictwie, kontrowersyjne zagadnienia dotyczące sposobu interpretacji norm kryminalizujących nieprawdziwe depozycje ze szczególnym uwzględnieniem wykładni § 1a art. 233 Kodeksu karnego.

The aim of this master thesis is to analyse the rules criminalising false depositions, contained primarily in the Article 233 of the polish Penal Code, in the light of their usefulness for the search for the truth about a criminal event in criminal proceedings. Considering the principle of material truth as the most important directive of the criminal process, the author wishes to draw attention to the interrelationship between the pursuit of the above-mentioned principle by the procedural authorities and crimes against the administration of justice - especially false testimony. This paper presents controversial issues, appearing both in the doctrine of criminal law and in the judicature, concerning the manner of interpreting the norms criminalising false depositions with particular emphasis on the interpretation of § 1a of the Article 233 of the polish Penal Code.
