Representation in criminal proceedings of a victim who is a natural person

Celem niniejszej pracy magisterskiej jest analiza, a następnie ocena obecnych regulacji dotyczących reprezentacji w postępowaniu karnym osoby pokrzywdzonej przestępstwem. Pod rozwagę zostanie poddana kwestia czy są one kompletne oraz czy zapewniają pokrzywdzonemu właściwy poziom ochrony jego interesów procesowych. Ze względu na szeroki krąg podmiotów mogących uzyskać status pokrzywdzonego w postępowaniu karnym opracowanie to skupiać się będzie jedynie na kwestiach reprezentacji osób fizycznych, tych które nie mogą samodzielnie występować w postępowaniu, jak i tych których co prawda takie ograniczenia nie dotyczą, jednakże ze względu na swoją nieporadność nie są w stanie w pełni wykonywać przysługujących im uprawnień. Wskazana instytucja zostanie omówiona w kontekście zastępstwa pokrzywdzonego w postępowaniu karnym zarówno przez jego przedstawiciela ustawowego, jak i przez ustanowionego dla niego profesjonalnego pełnomocnika będącego adwokatem lub radcą prawnym.

The aim of this master thesis is to analyze and then assess the current legal regulations regarding representation in the Polish criminal proceedings of a victim. The question whether they are complete and whether they provide the aggrieved party with an adequate level of protection of his procedural interests will be considered. Due to the wide range of entities able to obtain the status of a victim in criminal proceedings, this study will focus only on issues of representation of natural persons, those who can not independently appear in the proceedings, as well as those who do not involve such restrictions, however, due to their helplessness is not able to fully exercise their powers. The indicated institution will be discussed in the context of the substitution of the victim in criminal proceedings both by his statutory representative and by a professional attorney appointed for him.
