The Polish system of spatial development and planning

The following Ma thesis covers the issue of spatial development in Poland. It consist of three chapters. The first one is connected with the history of spatial development in Poland from 1918 to 1994.The second one presents the current legal status of spatial development regulated by the Act on Spatial Planning and Management from 2003: the planning procedure, the rules of spatial management and development, the financial effects of a planning decision. The last one includes the evaluation of spatial planning system in Poland, description of common problems which result from the numerous legal loopholes and the main assumption of the Act on Spatial Planning and Management Alteration. The issue of special development is one of the most important public goals, which influence not only on the living condition but also on appropriate use of real Estate and Land Property Stock according to the original land use, existence of service infrastructure, protected objects and places, state of the natural and cultural environment. According to the Act on Spatial Planning And Management the basic planing documents which allow to define and then realize the spatial policy are as follows :Study of the Condition and Direction of the Spacial Management of the Commune , The Local Spacial Management Plan, the Voivodship Spatial Management, the National Spatial Management Concept, and the Governmental programs include tasks contributing to the execution of supra-local public purposes.

Tematem niniejszej pracy magisterskiej jest system planowania i zagospodarowania przestrzennego w Polsce. Planowanie i zagospodarowanie przestrzenne jest niezwykle ważną dziedziną, wpływającą na kształt i funkcjonowanie otaczającej nas przestrzeni. Podstawowym aktem prawnym regulującym kwestie związane z planowaniem i zagospodarowaniem przestrzennym, zarówno na poziomie samorządowym jak i krajowym, jest ustawa z 27 marca 2003 r.Praca magisterska składa się z trzech rozdziałów. W rozdziale pierwszym została pokrótce zaprezentowana historia planowania i zagospodarowania przestrzennego w Polsce, od czasów II Rzeczpospolitej poprzez okres PRL do czasów transformacji ustrojowej i ustawy o zagospodarowaniu przestrzennym z 1994 roku poprzedzającej obecnie obowiązującą. Rozdział drugi został poświęcony w całości przedstawieniu obecnego systemu planowania przestrzennego, którego założenia normuje ustawa o planowaniu i zagospodarowaniu przestrzennym z 2003 roku. Omówiona została struktura aktów składających się na system, procedura ich tworzenia, zasady jakie zostały przyjęte przez ustawodawcę jako fundament funkcjonowania systemu, a także skutki finansowe jakie wywołuje zmiana zarówno przeznaczenia i sposobu użytkowania terenu, jak i zasad zagospodarowania danego obszaru. W rozdziale trzecim zostały zaprezentowany i omówiony stan planowania i zagospodarowania przestrzennego kraju, przedstawiono główne problemy praktyczne związane z jego funkcjonowaniem. Przedstawiono w nim również motywy i założenia nowelizacji ustawy o planowaniu i zagospodarowaniu przestrzennym.
