The state of necessity and collision of duties in medical activity. Selected problems.

Głównym celem pracy jest przedstawienie problemu stanu wyższej konieczności, w tym kolizji obowiązków w działalności leczniczej. Początkowa część pracy to scharakteryzowania przesłanek stanu wyższej konieczności na podstawie kodeksu karnego, oraz prezentowanych poglądów w doktrynie, ze szczególnym uwzględnieniem zasady proporcjonalności. W kolejnym etapie następuje opisanie stanu wyższej konieczności jako okoliczności wyłączającej bezprawność (kontratyp), oraz okoliczności wyłączającej winę. Następna część pracy dotyczy wyjaśnienia pojęć związanych z prawem medycznym, a mianowicie określenie co to są czynności lecznicze, co możemy uznać za chorobę, kto jest pacjentem, oraz scharakteryzować zabiegi lecznicze. Główna część pracy dotyczy przedstawienia przypadków usprawiedliwienia naruszenia przez lekarza kolidujących dóbr pacjenta takich jak: życie, zdrowie, czy prawo do stanowienia, poprzez instytucję stanu wyższej konieczności. Dotyczy sytuacji działania bez zgody pacjenta, zmiany zakresu zabiegu, czy przypadków kolizji obowiązków, gdzie spełnienie jednego z obowiązków jest związane z naruszeniem dóbr innej osoby.

The main purpose of master thesis is to present the problem of the state of necessity, including the collision of duties in the medical activity. The initial part of the work is to characterize the conditions of the state of necessity based on the Penal Code, and presented views in the doctrine, with particular emphasis on the principle of proportionality. The next step, the state of necessity is described as a circumstances excluding of illegality, and circumstances excluding of guilty. The next part of master thesis concern on the explanation of concepts related to medical law, namely the definition of what are therapeutic activities, what we can consider as a disease, who is a patient, and to characterize therapeutic treatments. The main part of the work concerns the presentation coincidences of justifying an infringement by the doctor of the conflicting patient’s interests, such as life, health, or the right of self-determination to form, through the institution of the state od necessity. It concerns situation acting without the consent of the patient, changes in the scope of the therapeutic treatments, or cases of conflict of duties, where fulfilment one of the duties is connected with infringement of another's goods.
