Restrictions of the trade in not-state-owned agricultural properties under Polish law

Praca niniejsza opisuje ograniczenia w obrocie nieruchomościami rolnymi, które nie są własnością Skarbu Państwa, wynikające z ustawy o kształtowaniu ustroju rolnego. Wskazane zostały ograniczenia podmiotowe, obowiązki nabywców nieruchomości rolnych oraz instytucje prawne służące ingerencji państwa w obrót własnościowy nieruchomościami rolnymi. Ponadto, opisane zostały instytucje prawne umożliwiające ingerencję państwa w obrót prawami do spółek prawa handlowego będących właścicielami lub użytkownikami wieczystymi nieruchomości rolnych. Praca niniejsza zawiera również opis restrykcji odnoszących się do obrotu nieruchomościami rolnymi zawartymi w historycznych regulacjach prawnych, które obowiązywały w Polsce. Ponadto, w pracy niniejszej zawarto ocenę aktualnie funkcjonujących rozwiązań prawnych oraz realizacji celu ustawy o kształtowaniu ustawy rolnego.

This Master’s thesis describes restrictions of the trade in agricultural properties that are non-state-owned, deriving from the Structuring of Agrarian System Act. There has been indicated subjective limitations, responsibilities of the purchasers of agricultural properties and legal institutions aimed at the state’s intervention in the proprietary trade in agricultural properties. Furthermore, legal institutions aimed at the state’s intervention in the trade in the rights to commercial law companies – being owner or perpetual usufructuary – has been described. The thesis also includes the description of the legal restrictions referring to the trade in agricultural properties contained in historical legal regulations that were applicable in Poland. Moreover, in this thesis the evaluation of currently functioning legal institutions and the realization of the Structuring of Agrarian System Act has been included.
