Civil Law Protection of the Human Voice

Praca podejmuje problematykę ochrony głosu człowieka z perspektywy polskiego prawa cywilnego. Omówione zostały dwie wiodące koncepcje - jako rodzaj wizerunku oraz jako odrębne dobro osobiste. Szczegółowej analizie poddano dobra osobiste oraz wizerunek w zakresie ich cech, ochrony oraz sporów doktrynalnych. W pracy przeanalizowano również podobieństwa między głosem a wizerunkiem oraz możliwość objęcia go ochroną przewidzianą dla wizerunku. Przeprowadzona analiza wykazała, iż głos przejawia istotne podobieństwa do wizerunku, jednak aktualne brzmienie przepisów wyklucza objęcie go właściwą dla wizerunku ochroną. Z tego powodu głos powinien być traktowany jako odrębne dobro osobiste.

This thesis explores the issue of protection of the human voice under Polish civil law. It discusses two leading concepts - the voice as a form of image or as an independent personal right. Personal rights and image are analysed in detail regarding their characteristics, legal protection and doctrinal disputes. The thesis also examines the similarities between the voice and image, as well as the possibility of extending image protection to the human voice. The analysis showed that the voice has significant similarities to image. However, current regulations do not allow the voice to be protected as image. Therefore, the human voice should be treated as a separate personal right.
