Rights and obligations of journalist in the light of Press Act

W pracy zostały opisane prawa i obowiązki dziennikarza w świetle ustawy Prawo prasowe z 26 stycznia 1984 r. W pracy szczególną uwagę zwrócono na powszechne prawo wolności wypowiedzi, które jest źródłem szeregu praw i obowiązków dziennikarza. W rozdziale pierwszym poza prawem do wolności wypowiedzi znajduje się opis prawa do informacji i prawa do krytyki. W rozdziale drugim zawarto opis obowiązków dziennikarza w zakresie służby społeczeństwu i państwu, głoszenia prawdy, obowiązek przestrzegania szczególnej staranności i rzetelności, obowiązek ochrony dóbr osobistych, zachowania tajemnicy zawodowej i obowiązek autoryzacji. W rozdziale tym wskazano, że obowiązki te wyznaczają zakres swobody wypowiedzi dziennikarza. Rozdział trzeci stanowi kontynuację rozdziału drugiego. Zawiera opis 3 zakazów: zakazu związanego z publikowaniem danych osobowych i wizerunku osób podejrzanych, zakazu wydawania dziennikarskich przesądów i zakazu krypotreklamy. Wskazano, że zakazy te ograniczają wspomnianą wolność wypowiedzi.

This paper describes the rights and obligations of journalists in the light of the Press Act of 26 January 1984. In this work particular attention is paid to the universal right to freedom of expression, which is the source of a number of rights and obligations of a journalist. In the first chapter besides of the right to freedom of expression is a description of the right to information and the right to criticize. The second chapter contains a description of the obligations of journalist in the service of society and the state, obligation of spreading the truth, complying with special care and accuracy, obligation to protect personal property, secrecy and authentication required. In this chapter we noted that these obligations shall determine the journalist's freedom of expression. The third chapter is a continuation of the second chapter. Describes the three prohibitions: the prohibition relating to the publication of personal data and the image of the suspects, a ban on the issue of journalistic prejudices and ban on surreptitious advertising. In this chapter it was pointed out that these prohibitions limit the said freedom of expression.
