Ombudsman for children in judicial administrative proceedings

Rzecznik Praw Dziecka (RPD) jako niezależny organ konstytucyjny o kompetencjach kontrolnych, inicjujących i ostrzegawczych zajmuje się przede wszystkim ochroną praw dzieci oraz dokonuje ocen o przestrzeganiu tych praw. Doprecyzowując, stoi on na straży podstawowych praw nieletnich określonych w Konstytucji Rzeczypospolitej Polskiej z 1997 roku, Konwencji Praw Dziecka i innych przepisach prawa. Konstytucja, w której instytucja RPD znajduje się w rozdziale II, odsyła do ustawy o Rzeczniku Praw Dziecka z dnia 6 stycznia 2000 roku, która z kolei zawiera szereg przepisów dotyczących pozycji ustrojowej Rzecznika, jego kadencji, powoływania oraz odwoływania, głównych kompetencji oraz kierunków działania. Art. 7 ustawy o Rzeczniku Praw Dziecka określa szczegóły jego pozycji ustrojowej – nie mieści się on w tradycyjnym trójpodziale władz.Pomimo tego, iż Konstytucja wprost nie wskazuje, że Rzecznik Praw Dziecka jest organem kontroli państwowej i ochrony prawa, może on być w pełni zaliczony do tej grupy instytucji.

The Ombudsman for Children, as an independent constitutional body with inspection, initiation and warning competencies, is primarily concerned with the protection of children's rights and makes assessments about the observance of these rights. More specifically, it upholds the fundamental rights of minors as defined in the 1997 Constitution of the Republic of Poland, the Convention on the Rights of the Child and other laws. The Constitution, in which the institution of the Ombudsman for Children is found in Chapter II, refers to the Law on the Ombudsman for Children of January 6, 2000, which in turn contains a number of provisions on the Ombudsman's constitutional position, his term of office, appointment and dismissal, main powers and lines of action. Article 7 of the Law on the Ombudsman for Children specifies the details of the Ombudsman's constitutional position - it does not fall within the traditional triad of authorities.Despite the fact that the Constitution does not explicitly indicate that the Ombudsman for Children is an organ of state control and protection of the law, he can be fully included in this group of institutions.
