Trade in private agricultural properties in polish legal system

Praca dotyczy ograniczeń w obrocie prywatnymi nieruchomościami rolnymi przewidzianych na gruncie ustawy o kształtowaniu ustroju rolnego. Opisane zostały zakres obowiązywania ustawy o kształtowaniu ustroju rolnego, ograniczenia podmiotowe i przedmiotowe, a także obowiązki nabywców nieruchomości rolnych. Wskazano środki kontroli obrotu nieruchomościami zarówno na płaszczyźnie administracyjnoprawnej, jak i cywilnoprawnej. Ponadto, scharakteryzowane zostały pośrednie środki kontroli obrotu, czyli prawo pierwokupu i prawo nabycia udziałów lub akcji w spółkach prawa handlowego będących właścicielami lub użytkownikami wieczystymi nieruchomości rolnych. Niniejsza praca magisterska zawiera także próbę oceny obecnie obowiązujących rozwiązań z punktu widzenia ich proporcjonalności i zgodności z zamierzonymi celami.

This Master’s thesis focuses on describing restrictions of the trade in private agricultural properties under the Act on the structuring of the Agrarian System. The scope of the Act on the structuring of the Agrarian System was described, as well as limitations and responsibilities of the purchasers of agricultural property. Both administrative law and civil law means of control were described. Furthermore, indirect means of control has been characterised, meaning right of pre-emption and right to acquire shares/stocks in commercial law companies being owner or perpetual usufructuar of agricultural properties. This thesis contents also an attempt of evaluation of commented Act based on its proportionality and whether the restricions are consistent with objectives being pursued.
