Schengen acquis-impact on the external and internal borders of the European Union

Głównym powodem napisania poniższej pracy magisterskiej była próba ukazania wpływu dorobku prawnego Schengen na funkcjonowanie granic wewnętrznych i zewnętrznych Unii Europejskiej. Fundamentalne znaczenie dla określenia zakresu pracy ma pojęcie acquis Schengen- czyli dorobku prawnego obejmującego Układ z Schengen wraz Konwencją Wykonawczą oraz wszystkie akty prawne, które zostały na nich oparte. Celem pracy jest udowodnienie, że Schengen to nie tylko brak kontroli granicznych na przejściach wewnątrz strefy, ale również nowy wymiar integracji europejskiej. W pierwszym rozdziale wskazano główne inicjatywy i rozwiązania, a także kontekst historyczny wydarzeń które wpłynęły na powstanie Schengen. Rozdział pierwszy pokazuje rozwój Schengen- od klasycznej umowy międzynarodowej po włączenie do prawa pierwotnego Unii. Drugi rozdział został poświęcony systemowi odpowiedzialnemu za przechowywanie i przetwarzanie danych osobowych w UE. Rozdział pokazuje również zakres danych przechowywanych w systemie oraz katalog podmiotów posiadających do nich dostęp. Trzeci rozdział porusza tematykę zasad przemieszczania się cudzoziemców na obszarze Unii Europejskiej. Rozdział przedstawia tok postępowania w przypadku wniosku wizowego. W tym rozdziale poruszono również kwestie wyjątków od reżimu wizowego ( umowy o małym ruchu granicznym, umowy wprowadzające ułatwienia wizowe). Rozdział przedstawia także stanowisko Trybunału Sprawiedliwości Unii Europejskiej w sprawie zasad obliczania maksymalnego czasu pobytu na podstawie umowy o małym ruchu granicznym. Kolejny rozdział dotyczy współpracy państw członkowskich w celu ochrony granic zewnętrznych. Opisano w nim procedurę dokonywania kontroli granicznych oraz politykę zintegrowanego zarządzania granicami zewnętrznymi. W tym rozdziale przedstawiono również przypadki tymczasowego przywrócenia kontroli granicznych na granicach wewnętrznych przez poszczególne państwa członkowskie. Rozdział piąty porusza problematykę azylu na gruncie prawa wspólnotowego. Ten rozdział pokazuje przede wszystkim kto i na jakich zasadach oraz jakie warunki musi spełnić, aby szukać schronienia na obszarze Unii Europejskiej. Rozdział zawiera również kryteria ustalania państwa właściwego do rozpoznania wniosku oraz zakres praw przyznawanych osobom objętym międzynarodową ochroną Praca magisterska oparta jest o regulacje prawne, które weszły w życie do 1 lipca 2013 roku.

The main purpose of this paper was to show an influence of Schengen area on the functioning of internal and external borders of the European Union. The Schengen area is a territory where the free movement of persons is guaranteed. In determining the scope of this paper a fundamental importance has the concept of the Schengen acquis which includes the Schengen Agreement and the Schengen Convention with all other acts based on them. The aim of this study is to prove that Schengen is not only the lack of border controls inside the zone but it is also a new stage of the European integration. The first chapter shows various initiatives and solutions , as well as the historical context of the events that contributed to the Schengen area. The first section shows the development of the Schengen - from classical international agreement at the beginning to the inclusion of the primary law of European Union. The second chapter is devoted to the system which is responsible for the storage and processing of personal data in the EU. Chapter also shows the range of the data stored in the system and the list of entities with access to them. The third chapter is focused on foreigners movement in the European Union . This chapter describes the visa application procedure . Third chapter also discussed the exceptions of the visa regime ( agreement on local border traffic , visa facilitation agreements ) . Furthermore, it also describes the stand taken by the Court of Justice of the European Union on the principles of calculating the maximum period of stay on the basis of an agreement on small border traffic. The next chapter deals with cooperation between Member States in order to protect the external borders. It describes the process of making border controls and the policy of the integrated management of external borders . This chapter describes the cases of the temporary reintroduction of border control on the Member States’ internal borders. The fifth chapter presents the issues of asylum on the basis of European law. This chapter shows who, on what terms and conditions could seek refuge in the European Union . It contains strict criteria for setting a competent State for an examination of an application and also a scope of the rights granted to beneficiaries of international protection. Master's thesis is based on the regulations that came into force up to 1 July 2013.
