Ochrona znaków towarowych przestrzennych o technicznym charakterze w prawie Unii Europejskiej.

W pracy została omówiona bezwzględna przeszkoda rejestracji z artykułu 7 ust. 1 lit. e tiret (ii) rozporządzenia 2017/1001 na wybranych przykładach z orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej. Przestrzenne znaki towarowe należą do niekonwencjonalnych oznaczeń. Problematyka pracy jest usytuowana na pograniczu ochrony patentowej i ochrony prawnoznakowej. Praca ukazała problem kumulatywnej ochrony w prawie własności intelektualnej. Ukazanie genezy, ewolucji i funkcji obu reżimów miało na celu uwidocznienie różnic między nimi. W pracy przedstawiono dwa wyroki: C-299/99 Philips v Remington i C-48/09 P Lego v EUIPO. Zostały omówione znaczące pojęcia takie jak pojęcie przeciętnego konsumenta, zasadniczych właściwości, efektu technicznego, interesu ogólnego, zdolności odróżniającej oraz oznaczeń, które powstały „wyłącznie” przez kształt towaru, który jest „niezbędny” do uzyskania efektu technicznego. Ostatnie pojęcie było kluczowe dla rozważań Trybunału i argumentów stron. Rozwiązaniem problemu godzącym interes ogólny z indywidualnym byłoby zaproponowane przez rzecznika generalnego Paola Mengozziego zawężenie prawa ochronnego do elementów istotnych i odróżniających niemających charakteru funkcjonalnego. Niestety rygorystyczna zasada stosowana przez EUIPO, wedle której jest niemożliwe żądanie ochrony jednego z elementów, gdy oznaczenie ma ich wiele, stanowi przeszkodę dla tego rozwiązania. Ta zasada nie jest wywiedziona z orzecznictwa TSUE, zalecane jest więc złagodzenie tej praktyki poprzez stosowanie oświadczeń o zrzeczeniu się praw wyłącznych w szerszym zakresie.
In the dissertation the absolute ground for refusal from article 7(1)(e)(ii) regulation 2017/1001 was explained on chosen examples of the European Court of Justice judgments. Three-dimensional trade marks are unconventional marks. The problematic aspect is oriented on the border between patent and trade mark protection. The thesis outlined the problem of accumulation of protection in intellectual property law. The purpose of presenting origin, evolution and functions of both regimes was to reveal differences between them. In the dissertation two cases were examined: C-299/99 Philips v Remington and C-48/09 P Lego v EUIPO. Essential concepts were discussed such as an average consumer, essential features, technical result, general interest, distinctiveness and signs which consist exclusively of the shape of goods which is necessary to obtain a technical result. The latter term was essential to the considerations of the ECJ and the parties’ arguments. The solution to the problem, which reconciles the general interest with the individual one, would be restricting a trade mark’s right to the essential and distinctive non-functional elements as proposed by advocate general Paolo Mengozzi. Unfortunately, rigorous rule enforced by the EUIPO which states it is impossible to request a protection for only one element, while a sign has many of them, is an obstacle for this solution. This rule is not derived from ECJ judgments, thus it is advised to mitigate that practice through usage of testimonies waiving exclusive rights to a wider extent.
