The European Union and the issues of protection of human rights

Celem niniejszej pracy jest przedstawienie funkcjonowania systemu ochrony praw człowieka stworzonego w ramach Unii Europejskiej. W rozdziale pierwszym ukazana została problematyka rozwoju idei praw człowieka, opisane zostały cechy tych praw a także zaprezentowano ich klasyfikację. Zawarto w nim również informacje dotyczące podstaw prawnych, na jakich opiera się ich ochrona w ramach Unii Europejskiej. W dalszej części opracowania przedstawiono status prawny Karty Praw Podstawowych, problematykę obowiązywania Protokołu (nr 30) w sprawie stosowania Karty Praw Podstawowych Unii Europejskiej do Polski oraz Zjednoczone Królestwa a także organizację i kompetencje Agencji Praw Podstawowych. Rozdział trzeci skupia się na analizie postanowień Karty Praw Podstawowych. Przedstawiono w nim relacje tego dokumentu do innych międzynarodowych aktów prawnych, poruszających problematykę praw oraz wolności człowieka. Rozdział czwarty skupia się na funkcjonowaniu czterech organów: Trybunału Sprawiedliwości Unii Europejskiej, Europejskim Rzeczniku Praw Obywatelskich, Parlamencie Europejskim oraz Komisji Europejskiej. W ostatniej części zaprezentowano problematykę przystąpienia Unii Europejskiej do Europejskiej Konwencji Praw Człowieka.

The aim of this work is to present the functioning of the system of human rights protection created within the European Union. The first chapter presents the issue of the development of the idea of human rights, describes the features of these rights and presents their classification. It also contains information on the legal basis on which their protection is based in the European Union. The next part of the study presents the legal status of the Charter of Fundamental Rights of the European Union, the issue of the applicability of Protocol (No. 30) on the application of the Charter of Fundamental Rights of the European Union to Poland and to the United Kingdom as well as the organization and competences of the Fundamental Rights Agency. The third chapter focuses on the analysis of the provisions of the Charter of Fundamental Rights. It presents the relationship of this document to other international legal acts addressing the issues of human rights and freedoms. The fourth chapter focuses on the functioning of four bodies: the Court of Justice of the European Union, the European Ombudsman, the European Parliament and the European Commission. The last part presents the problems of European Union accession to the European Convention on Human Rights.
