Proceedings in cases concerning misdemeanors

Tematem pracy jest postępowanie mandatowe w sprawach o wykroczenia. Praca składa się z czterech merytorycznych rozdziałów. Temat dotyczy konstrukcji postępowania mandatowego, jego oceny oraz potrzeby zmian. Należy zastanowić się czy postępowanie to realizowane jest z zachowaniem postulatu efektywności, braku sformalizowania, szybkości i braku nadmiernych kosztów.Rozdział pierwszy skupia się na istocie postępowania mandatowego oraz jego najważniejszych odrębnościach. Dalsza część dotyczy konstytucyjnych i konwencyjnych aspektów nakładania kary grzywny drogą mandatu karnego.Przedstawione zostały przesłanki pozytywne jak i negatywne zastosowania trybu mandatowego oraz problematyka czynności wyjaśniających. Drugi rozdział to problematyka rodzajów mandatów karnych oraz ich efektywności. Dopełnieniem jest poruszenie tematu wniosku o ukaranie z naciskiem na problematykę prawa do obrony. Zastanowiono się nad konkretnymi kompetencjami organów właściwych do nakładania grzywny mandatem karnym oraz nad ich szerokim katalogiem. Ostatni rozdział stanowi rozważania nad instytucją uchylenia prawomocnego mandatu karnego.Praca została wzbogacona opiniami funkcjonariuszy Policji na temat zwiększenia efektywności postępowania mandatowego oraz jego głównych problemów.

The subject of this work is the analysis of the investigation in cases concerning misdemeanors in Poland. The structure of the work consists of four chapters. The topic concerns the construction of mandate proceedings, its evaluation and the need for changes. It should be considered whether this procedure is carried out with the requirement of efficiency, lack of formalization, speed and lack of excessive costs. The first chapter focuses on the nature of the mandate proceedings and its most important separations. The remainder concerns the constitutional and conventional aspects of imposing a fine by way of a penalty mandate. Positive as well as negative applications of the mandate procedure and the problem of explanatory actions were presented. The second chapter is the issue of types of penalty tickets and their effectiveness. It is complemented by raising the subject of the application for punishment with an emphasis on the issue of the right to defense. The specific competences of the authorities competent to impose a fine on the penal fines and on their broad catalog were discussed. The last chapter is a reflection on the institution of repealing a valid penalty mandate.The work was enriched by the opinions of Police officers about the increase in the effectiveness of the mandate proceedings and its main problems.
