Alleged set-off as the basis for counter-execution action

Tematem niniejszej pracy jest zarzut potrącenia jako podstawa powództwa o pozbawienie tytułu wykonawczego wykonalności. W rozdziale pierwszym scharakteryzowano modele potrącenia występujące w innych państwach oraz zaprezentowano polskie regulacje dotyczące potrącenia. Rozdział drugi poświęcono ogólnej charakterystyce zarzutu potrącenia oraz powództwa opozycyjnego. Kolejny rozdział obejmuje analizę historycznoprawną instytucji zarzutu potrącenia jako podstawy powództwa opozycyjnego. Przedmiotem analizy były regulacje niemieckie, austriackie i rosyjskie obowiązujące w Polsce do lat trzydziestych XX wieku oraz przepisy polskiego Kodeksu postępowania cywilnego z 1930 r. i regulacje zawarte w aktualnie obowiązującej w Polsce ustawie procesowej z 1964 r. W ostatnim (czwartym) rozdziale scharakteryzowano problematykę zarzutu potrącenia jako podstawy powództwa opozycyjnego po zmianach wprowadzonych na mocy ustawy z 4 lipca 2019 r. o zmianie ustawy - Kodeks postępowania cywilnego. Omówiono w nim także instytucję potrącenia w słowackim postępowaniu egzekucyjnym.

The subject of this thesis is the set-off defense as the basis for an action to limit or cancel the enforceability of an enforceable title. Chapter one characterises models of set-off occurring in other countries and presents Polish legal regulations of set-off. The second chapter is devoted to the general characteristics of the allegation of set-off and the counter-execution action. The next chapter includes a legal-historical analysis of the institution of the allegation of set-off as a basis for an counter-execution action. The subject of the analysis was the German, Austrian and Russian regulations in force in Poland until the 1930s, as well as the provisions of the Polish Code of Civil Procedure of 1930 and the regulations contained in the current Polish Code of Civil Procedure of 1964. The last (fourth) chapter characterises the issue of the allegation of set-off as a ground for an counter-execution action after the changes introduced by the Act of 4 July 2019 amending the Act - Code of Civil Procedure. It also discusses the institution of set-off in Slovak enforcement proceedings.
