Usucaption of real estate and division of property for use (quoad usum)

Niniejsza praca ma na celu analizę zagadnienia możliwości nabycia części nieruchomości będącej przedmiotem podziału quoad usum w wyniku zasiedzenia. Praca składa się z siedmiu rozdziałów. Rozdział 1 zawiera rozważania o istocie i funkcjach zasiedzenia. W Rozdziale 2 zostały przeanalizowane przesłanki zasiedzenia nieruchomości. Rozdział 3 i 4 opisują przedmiot i podmiot zasiedzenia. Istota podziału quoad usum została określona w Rozdziale 5. W Rozdziale 6 została dokonana analiza możliwości zasiedzenia udziału we współwłasności nieruchomości. Rozważania na temat możliwości nabycia części nieruchomości będącej przedmiotem podziału quoad usum w wyniku zasiedzenia zostały zawarte w Rozdziale 7.

The main purpose of the master’s thesis is bringing comprehensive analysis of acquisition by way of usucaption of physical parts of a real property which is divided for use (quad usum).The thesis consists of seven chapters. Chapter 1 contains considerations on the essence and functions of acquisition of real property by way of usucaption. The conditions of acquisition of real property are contained in Chapter 2. Chapter 3 and 4 present subject and object of usucaption whereas the essence of division of property for use is considered in Chapter 5. Chapter 6 brings an analysis of acquisition of a share in real property by way of usucaption. The subject of Chapter 7 is an analysis of problem of acquisition by way of usucaption of physical parts of a real property which is divided for use (quad usum).
