Lower-level Ancillary Units of local government

Praca stanowi próbę pierwszego całościowego ujęcia zagadnienia jednostek pomocniczych niższego rzędu, tworzonych na podstawie art. 35 ust. 2 ustawy o samorządzie gminnym. Jej celem jest analiza tej szczególnej formy organizacyjnej w strukturze gminy – niemal w ogóle nie opisywanej w literaturze prawniczej i dotąd niedostatecznie zbadanej.W pracy omówiono genezę oraz historię regulacji, a także możliwości i przesłanki powoływania jednostek pomocniczych niższego rzędu. Przedstawiono sposób ich tworzenia, status prawny, zakres zadań, organizację wewnętrzną oraz ich miejsce w systemie partycypacji obywatelskiej. Szczególną uwagę poświęcono także zagadnieniom wyborczym, statusowi przedstawicieli tych jednostek, formom nadzoru i kontroli, jak również analizie porównawczej – zarówno w wymiarze krajowym, jak i praktycznym.Zwieńczeniem pracy jest próba sformułowania wniosków dotyczących racjonalności i zasadności powoływania jednostek pomocniczych niższego rzędu w praktyce samorządowej.

This thesis represents an attempt at the first comprehensive analysis of the institution of lower-level auxiliary units (subordinate auxiliary units), established pursuant to Article 35(2) of the Act on Municipal Self-Government. Its aim is to examine this unique organizational form within the municipal structure – one that is rarely discussed in legal literature and has so far remained insufficiently studied.The thesis explores the origins and historical development of the relevant legal regulations, as well as the conditions and justifications for establishing such units. It presents their method of creation, legal status, scope of tasks, internal organization, and their role in the system of civic participation. Particular attention is given to electoral issues, the legal status of their representatives, mechanisms of oversight and control, and a comparative analysis – both on a national and practical level.The work concludes with an attempt to formulate recommendations regarding the rationality and legitimacy of establishing lower-level auxiliary units within the framework of local government practice.
