The legal status of the Polish deputy and senator

Status prawny posła i senatora z racji sprawowanych funkcji państwowych przez parlamentarzystów jest uregulowany w Konstytucji Rzeczypospolitej Polskiej, ustawach a także innych aktach normatywnych. Obecny kształt polskiej regulacji dotyczącej zagadnień statusu prawnego deputowanych uzasadnia podział pracy na cztery części. W pierwszej z nich analizowana będzie problematyka mandatu parlamentarnego w szerokim znaczeniu, połączona z opisem warunków nabycia oraz wygaśnięcia mandatu. Druga część będzie dotyczyć podstawowej gwarancji niezależnego wykonywania mandatu jaką jest immunitet parlamentarny. Szczegółowo zostanie scharakteryzowana instytucja immunitetu materialnego, immunitetu formalnego a także kwestie związane z nietykalnością parlamentarną. Deputowanym przysługują określone prawa a także obowiązki, zagadnienia te będzie poruszać rozdział trzeci. Czynności które powinny być wykonywane wewnątrz izby parlamentu a także poza nią mają kluczowe znaczenie dla kompleksowej analizy statusu prawnego deputowanych. Ostatni rozdział skupiać się będzie na kwestiach związanych ze statusem socjalnym deputowanych które wynikają z ustawy o wykonywaniu mandatu posła i senatora. Przedstawiona systematyka pracy pozwala na szczegółową analizę wszystkich kluczowych zagadnień dotyczących pozycji prawnej parlamentarzystów i dokładne przedstawienie istoty mandatu.

Legal status of deputy and senator, by virtue of the public function performed by the parliamentarians, is regulated by the Polish Constitution, laws and other normative acts. The current shape of Polish legislation concerning legal status of deputies, justify the division of master thesis into four parts. In the first of them will be fully analyzed parliamentary mandate in a broad sense, combined with conditions of beginning and expiration of the mandate. The second part will cover basic guarantees the independent holding of the mandate, which is the parliamentary immunity. In detail the immunity terms will be characterized by non-accountability and formal immunity as well as issues related to the parliamentary inviolability. Deputies are entitled to certain rights and duties, these issues will be analyzed in chapter three. Operations that should be carried out within the chambers of the parliament and beyond are essential for a comprehensive analysis of the legal status of parliamentarians. The final chapter will focus on issues related to the social status of deputies that result from the act on the discharge of their duties by deputies and senators. The presented work scheme allows for detailed analysis of all the key issues of the legal status of parliamentarians and accurate representation of the essence of the mandate.
