Persecutions on political, racial and religious grounds as a crime against humanity in the light of the case law of The International Criminal Tribunal for the Former Yugoslavia.

Przedmiotem niniejszej pracy jest problematyka prześladowania politycznego, rasowego i religijnego jako zbrodni przeciwko ludzkości. Autorka podejmuje próbę prześledzenia sposobu ujmowania tego zagadnienia opierając się na statutach międzynarodowych trybunałów wojskowych, międzynarodowych trybunałów karnych ad hoc oraz Statutu Rzymskiego Międzynarodowego Trybunału Karnego. Praca dotyka ważkich problemów braku regulacji zbrodni przeciwko ludzkości na poziomie konwencji międzynarodowej oraz braku jednoznacznego zdefiniowania pojęcia prześladowania w prawie międzynarodowym. W procesie dekodowania stanu prawnego w zakresie poruszanej problematyki koniecznym jest sięgnięcie do międzynarodowego prawa zwyczajowego. Rozważania autorki ogniskują się głównie wokół bogatego dorobku orzeczniczego Międzynarodowego Trybunału Karnego dla byłej Jugosławii w poruszanej tematyce.

This thesis is an analysis of persecution on political, racial and religious grounds as a crime against humanity. The author attempts to follow the approach to this issue based on the statutes of international military tribunals, international criminal tribunals ad hoc and the Rome Statute of the International Criminal Court. The present study rises the important issue concerning the lack of regulations regarding to crimes against humanity at the level of the international convention and the absence of an unequivocal definition of persecution in international law. In the process of decoding the legal status in the scope of the discussed issues, it is necessary to refer to customary international law. The author's considerations focus mainly on the rich jurisprudence of the International Criminal Tribunal for the former Yugoslavia in this matter.
