Sexual Cybercrimes Against Minors

W pracy dokonano oceny zagrożeń związanych z cyberprzestępczością seksualną wobec małoletnich, ze szczególnym uwzględnieniem przestępstwa groomingu oraz rozpowszechniania treści pornograficznych. Przeanalizowano przepisy prawne dotyczące ochrony dzieci, w tym art. 200a i 202 Kodeksu karnego, jak również regulacje międzynarodowe. Przedstawiono prawne aspekty ochrony małoletnich przed cyberprzestępczością, omawiając krajowe i międzynarodowe regulacje. Omówiono skalę zjawiska cyberprzestępczości seksualnej na szkodę dzieci, z uwzględnieniem statystyk oraz dokonano porównań w stosunku do rozmiarów, nasilenia i dynamiki innych przestępstw. Podjęto także próbę charakterystyki sprawców i ofiar, ukazując mechanizmy nawiązywania kontaktu oraz manipulacji ofiarą przez sprawców. Omówiono również możliwości działań prewencyjnych i środków ochrony, takich jak edukacja dzieci, kontrola rodzicielska oraz inicjatywy organizacji pozarządowych i organów ścigania. Na podstawie analiz stwierdzono, że cyberprzestępstwa seksualne wobec małoletnich stanowią rosnące zagrożenie, a obecne przepisy prawne, mimo ich istotności, muszą być uzupełniane o działania prewencyjne i edukacyjne, które zwiększą świadomość wśród dzieci i młodzieży.

The thesis assesses the risks associated with sexual cybercrime against minors, with particular emphasis on the crime of grooming and the dissemination of pornographic content. Legal provisions for the protection of children, including Articles 200a and 202 of the Penal Code, as well as international regulations, have been analyzed. The legal aspects of child protection against cybercrime have been presented, discussing both national and international regulations. The scale of sexual cybercrime against children has been discussed, taking into account statistics, and comparisons have been made in relation to the size, intensity, and dynamics of other crimes. An attempt has also been made to characterize perpetrators and victims, showing the mechanisms of contact initiation and manipulation of the victim by the perpetrators. The possibilities of preventive actions and protective measures, such as child education, parental control, and initiatives by non-governmental organizations and law enforcement agencies, have also been discussed. Based on the analysis, it has been concluded that sexual cybercrime against minors is a growing threat, and existing legal provisions, despite their importance, must be supplemented by preventive and educational measures to raise awareness among children and adolescents.
