Celem danej pracy jest analiza statusu prawnomiędzynarodowego Republiki Chińskiej na Tajwanie oraz próba odpowiedzi na pytanie, czy Republika Chińska jest podmiotem prawa międzynarodowego. Po wojnie domowej w Chinach i powstaniu Chińskiej Republiki Ludowej w dniu 01.01.1949 powstał problem dwóch rządów jednego państwa. Po rezolucji ZO ONZ numer 2758 w 1971 rząd Republiki Chińskiej na Tajwanie utracił uznanie prawie wszystkich państw świata. Dana praca składa się z 5 rozdziałów. Pierwszy jest poświęcony zagadnieniu podmiotowości w prawie międzynarodowym oraz katalogu podmotów tego prawa. Drugi rozdział dotyczy kwestii historycznej danego problemi, z szczególnym uwzględnieniem różnych aktów prawnych. Trzeci rozdział mówi o tym, czy jest Tajwan państwem w świetle prawa międzynarodowego. Czwarty i piąty rozdziały dotyczą problematyki stosunków Republiki Chińskiej na Tajwanie z państwami, które uznają ten rząd za rząd Chin, oraz państwami, które nie uznają tego rządu za rząd Chin.
The aim of this thesis is to analyze the legal status of the Republic of China on Taiwan in the light of international law and attempt to answer if Taiwan is the subject of international law. After the end of civil war in China and proclamation of the People's Republic of China on 01.01.1949 the problem of two governments within one state has appeared. After the GA of the UN Resolution number 2758 in 1971 the Government of the Republic of China has lost its recognition among the vast majority of states around the world. This thesis is consisted of 5 chapters. The first chapter is about legal personality in international law and the catalogue of legal persons in this field of law. The second one is devoted to the question of history of this problem, with taking into account of different international law documents. The third chapter is an attempt to answer if the Republic of China on Taiwan is a state in the light of international law. The 2 last chapters shows, how the Republic of China on Taiwan engages into international relations with states, which recognize its government, and with states, which do not recognize its government.
