Prezydent w Polsce i w Niemczech. Analiza prawno konstytucyjna

Celem napisania mojej pracy była próba przedstawienia pozycji ustrojowej Prezydenta Rzeczpospolitej Polskiej oraz Prezydenta Republiki Federalnej Niemiec na podstawie rozwiązań konstytucyjnych zawartych w Ustawie Zasadniczej i w Konstytucji RP. Jest to praca pisana pod kątem porównawczym, a by całość pracy była usystematyzowana zostały w niej zawarte pewne wiadomości dotyczące historii konstytucjonalizmu Polski i Niemiec. Starałam się w jasny sposób przedstawić model niemieckiej oraz polskiej prezydentury a także proces jej kształtowania się w praktyce ustrojowej Niemiec i Polski by podkreślić rzeczywiste oblicze prezydentury w omawianych państwach. W mojej pracy bardzo chciałam pokazać różnice oraz podobieństwa jakie występują pomiędzy instytucją urzędu Prezydenta RP a Prezydenta Federalnego. Jednym z decydujących czynników, który wpłynął na wybranie właśnie takiego tematu przeze mnie było znaczne ograniczenie instytucji Prezydenta w Republice Federalnej Niemiec. Z punktu widzenia ogólnego instytucja głowy państwa w systemie rządów parlamentarno gabinetowym jest ważnym i nieodłącznym czynnikiem władzy w państwie. Jako podmiot realizuje swoje kompetencje sam a dzięki nim wpływa na ustrój polityczny w danym kraju. Jednak praktyka ustrojowa oraz podłoże historyczne Niemiec zmieniły kształt oraz pozycję ustrojową Prezydenta Niemiec i przeobraziły jego pozycję ustrojową we władzę, która odgrywa rolę bardziej neutralną w państwie. Wśród przyczyn takiej rzeczy na pierwszy plan wysuwają się negatywne doświadczenia jakie były związane z urzędem prezydenckim w okresie republiki weimarskiej. Wtedy to prezydent miał w swoich rekach o wiele większe uprawnienia niż teraz posiada. W związku z powyższym teraźniejszy sposób ukształtowania pozycji Prezydenta Federalnego w Niemczech jest przeciwieństwem prezydentury jaka występowała w republice weimarskiej. W porównaniu do pozycji ustrojowej Prezydenta Federalnego Prezydenta RP jest podmiotem, któremu Konstytucja przypisała charakter prezydentury aktywnej. Wyrazem tego są między innymi liczne prerogatywy, których niestety Ustawa Zasadnicza w o wiele mniejszym stopniu nadała Prezydentowi Federalnemu. Pomimo tak wielu różnic i rozbieżności, pomiędzy modelami prezydentury w Polsce i w Niemczech są one jednak podobne. Zarówno Prezydent Federalny jak i Prezydent RP pełnią funkcje głowy państwa. Świadczy o tym ich funkcja reprezentacyjna jaką wykonują. Klasyczna funkcja prezydenta jaką jest reprezentowanie państwa w stosunkach wewnątrzpaństwowych i na arenie między narodowej podkreśla ich najwyższe przedstawicielstwo państwa.

There was an attempt to introduce the President to the political position in order to write my work of the Republic of Poland and the President of the Federal Republic of Germany based on constitutional solutions included in the constitution and in the Polish constitution. it is work written under the comparative angle, and the whole of the work would be systematized in it certain news concerning the history of the constitutionalism of Poland and the German were entered into. I tried in the bright way to describe the model of the German and Polish presidency as well as the process of her forming oneself in practice political of Germany and Poland in order to emphasize the real face of the presidency in discussed states. At my work very much I wanted to show differences and resemblances which are appearing among the institution of the office of the president of Poland but the Federal President. With one of deciding factors which influenced for choosing exactly such a subject by me there was a significant limitation of the institution of the presidency in the Federal Republic of Germany. From a general point of view institution of the head of state in the government system parlamentarno cabinet is important and with key factor of the power in the state. As the subject he is carrying his competence out alone and thanks to them affects the political system in the given country. However political practice and historical base of Germany changed the shape and the political position of president Germany and transformed his political position into the power which is playing more neutral lines in the state. Amongst causes of such a thing negative experience which were associated with the presidential office in the period of the Weimar republic is coming to the fore.Then the president had it in his hands has far more bigger entitlements than now. With reference to the above the present way of forming the position of the Federal President in Germany is an opposite of the presidency which appeared in the Weimar republic. In comparing to the political position the President of the Federal president of Poland he is a subject to which the Constitution attributed character of the active presidency.
