Constitutional pillars of the social market economy

Tematem niniejszej pracy są konstytucyjne filary społecznej gospodarki rynkowej. W rozdziale pierwszym przedstawiono definicję swobody działalności gospodarczej oraz jej umocowanie jako konstytucyjnej zasady ustrojowej i cechy działalności gospodarczej, opisane w orzecznictwie sądów. W drugim rozdziale omówiono pojęcie własności prywatnej oraz jego ograniczenie w postaci instytucji wywłaszczenia na inwestycje drogowe. Rozdział trzeci opisuje zasadę solidaryzmu i dialogu społecznego realizowanego przez władze publiczne poprzez utworzenie publicznego forum dialogu pomiędzy partnerami społecznymi: pracownikami, pracodawcami, stroną rządową w Radzie Dialogu Społecznego.

The subject the thesis are constitutional pillars of the social market economy. The first chapter presents the definition of the freedom of economic activity and its legitimacy as a constitutional principle of the political system and the features of economic activity, described in the judgments of the courts. The second chapter describes the concept of private property and its limitation in the form of the institution of expropriation for road investments. The third chapter presents the principle of solidarity and social dialogue implemented by public authorities through the creation of a public forum for dialogue between social partners: employees, employers, the government side in the Social Dialogue Council.
