Abuse of procedural right in civil proceedings

Tematem niniejszej pracy magisterskiej jest nadużycie prawa procesowego w postępowaniu cywilnym. Rozdział pierwszy zawiera omówienie ogólnych zagadnień z zakresu postępowania cywilnego, jak również genezy i definicji pojęcia nadużycia prawa procesowego. Przedstawiono w nim także zagadnienie możliwości zastosowania art. 5 k.c. w odniesieniu do instytucji prawa procesowego, a także relację pomiędzy art. 3 k.p.c. i nowym art. 4(1) k.p.c. Rozdział drugi został poświęcony analizie instytucji nadużycia prawa procesowego na gruncie poprzedniego stanu prawnego, z uwzględnieniem rysu historycznego oraz orzecznictwa polskich sądów. Rozdział trzeci zawiera charakterystykę głównych celów oraz założeń nowelizacji k.p.c. z dnia 4 lipca 2019 r. w zakresie problematyki nadużycia prawa procesowego, a także analizę skutków prawnych tego nadużycia oraz ocenę wprowadzonych zmian stanu prawnego (z uwzględnieniem zarówno korzyści, jak i potencjalnych zagrożeń). Przedmiotem ostatniego (czwartego) rozdziału są poszczególne przypadki nadużycia prawa procesowego uregulowane w Kodeksie postępowania cywilnego.

The subject of this master’s thesis is the abuse of procedural right in civil proceedings. The first chapter contains the description of general issues related to civil proceedings and the genesis and definitions of the abuse of a legal process. This part of the thesis also presents the possibility of applying art. 5 of the Civil Code to institutions of procedural law and the relation between art. 3 and newly introduced art. 4(1) of the Code of Civil Procedure. The second chapter is devoted to the analysis of the institution of abuse of procedural right, regarding the previous state of law and taking into account the historical outline and the case-law of the Polish courts. The third chapter presents the characteristics of the main objectives and assumptions related to the amendment to the Polish Code of Civil Procedure of 4th of July 2019, concerning the abuse of procedural right, as well as the analysis of the legal consequences of abuse and the evaluation of changes (in terms of both benefits and potential risks). The final (fourth) chapter describes the regulation of particular instances associated with the abuse of procedural right in the Code of Civil Procedure.
