Ownership transformation of real estate against the background of legal changes. Case study

Przedmiotem pracy uczyniono dzieje nieruchomości położonej w Rychwałdzie zagadnienie to ukazuje losy tego obszaru wraz ze zmieniającymi się przepisami prawa, ale także czynnikami politycznymi a w szczególności ustrojem państwa. Teren, na którym znajduje się przedmiotowa nieruchomość był położony na obszarze obowiązywania austriackiego kodeksu cywilnego (ABGB), wskutek nieuregulowania wszystkich gałęzi prawa w okresie II Rzeczypospolitej regulacja pozaborcza obowiązywała nadal. Początkowo wszelkich czynności prawnych dokonywano według kodeksu ABGB, także w okresie II Rzeczypospolitej. Do istotnych zmian doszło po II wojnie światowej, gdy władza ludowa postanowiła odebrać nieruchomość zakonowi Dominikanek, na którym wybudowały szkołę. Ostatecznie pozbawiono tej nieruchomości zarówno zakonnice jak i osobę która miała tam prawo dożywocia. W Polsce Ludowej prywatna własność nie podlegała ochronie prawnej.

The subject of the work was the history of the property located in Rychwałd. This issue shows the fate of this area with changing legal regulations, but also political factors, in particular the state system. The area in which the property in question is located was located in the area of ​​​​applicability of the Austrian Civil Code (ABGB), due to the lack of regulation of all branches of law during the Second Polish Republic, non-partitional regulations were still in force. Initially, all legal transactions were performed in accordance with the ABGB Code, also during the Second Polish Republic. Significant changes took place after World War II, when the people's authorities decided to take away the property from the Dominican Order, on which they had built a school. Ultimately, both the nuns and the person who had the right to life imprisonment there were deprived of this property. In the People's Republic of Poland, private property was not subject to legal protection.
