Zasadniczym celem pracy jest analiza piśmiennictwa i orzecznictwa poświęconych problematyce nazwy handlowej, która pozostaje nadal niewyjaśniona. Polska jest obowiązana zapewnić ochronę nazwy handlowej na mocy art. 8 konwencji paryskiej. Nie zawiera on definicji tegoż pojęcia, ani przesłanek ochrony.
Abstract in English
This work is aimed at analysis of literature and court decisions regarding use of trade names, which still remains unexplained. Poland is obliged to protect the trade name under Art. 8 of the Paris Convention. This article does not include the definition of trade name. Paris Convention also does not include any remedies in case of trade name infringement.
