Prudential threshold of public debt and prudential procedures as an instrument of protection against the increase of public debt in Poland

Poziom długu publicznego jest jednym z kluczowych wskaźników ilustrujących kondycje finansów publicznych państwa. Z kolei kontrola poziomu deficytu i długu publicznego ma w każdym państwie doniosłe znaczenie, gdyż stanowi filar stabilności finansów publicznych. Istniejące regulacje prawne oddziaływają na gospodarkę. Polska jest jednym z niewielu krajów na świecie, w którego konstytucji zawarto ograniczenie długu publicznego. Rozwinięciem konstytucyjnego progu sanacyjnego są zawarte w ustawie o finansach publicznych progi ostrożnościowe. Razem stanowiły one punkt odniesienia dla polityki fiskalnej i budżetowej państwa oraz barierę dla niekontrolowanego wzrostu zadłużenia.Celem niniejszej pracy jest próba analizy miejsca w polskim porządku prawnym konstytucyjnego progu zadłużenia wraz z będącymi jego dopełnieniem regułami ostrożnościowymi wprowadzonymi mocą ustawy o finansach publicznych. Ambicją autora jest również przedstawienie uwarunkowań ekonomicznych progów zadłużenia oraz ewolucji poglądów doktryny ekonomicznych jakie miały wpływ na wykształcenie tej instytucji.

The level of public debt is one of the key indicators illustrating the condition of public finances of the state. In addition to that, the control of the level of deficit and public debt is important in every country, as it is a pillar of the sustainability of public finances. Existing legal regulations affect the economy. Poland is one of the few countries in the world where the constitution contains a limitation of public debt. The Public Finance Act includes supplemental prudential thresholds. Together, they were a reference point for the fiscal and budgetary policy of the state and a barrier to uncontrolled debt growth.The aim of this work is to analyze the place in the Polish legal order of the constitutional debt threshold with its complementary prudential rules introduced by the Public Finance Act. The author's ambition is also to present the economic conditions of the debt thresholds and the evolution of the views of economic doctrines that had an impact on the evolution of this institution.
