Deepfakes in Political Communication: A Comprehensive Analysis and Evaluation of the EU Regulatory Framework

Niniejsza praca zawiera kompleksową analizę unijnych ram regulacyjnych dotyczących zjawiska deepfake w kontekście współczesnej komunikacji politycznej oraz ochrony integralności procesów demokratycznych. W pierwszej części omówiono technologiczne podstawy zjawiska deepfake oraz ewolucję komunikacji politycznej w środowisku cyfrowym, co pozwoliło ukazać skalę zagrożeń, jakie dezinformacja wykorzystująca sztuczną inteligencję stwarza dla rzetelności debaty publicznej. Następnie przeprowadzono szczegółową analizę unijnych ram prawnych, koncentrując się na potrójnym reżimie regulacyjnym tworzonym przez Akt o sztucznej inteligencji, Akt o usługach cyfrowych oraz Ogólne rozporządzenie o ochronie danych, co umożliwiło określenie zakresu i funkcji poszczególnych mechanizmów regulacyjnych. Ostatnią część pracy stanowi krytyczna ocena skuteczności tych instrumentów, w której wskazano strukturalne opóźnienie procedur unijnych względem tempa innowacji technologicznych oraz zestawiono je z kompetencjami państw członkowskich. Na tej podstawie sformułowano wniosek, że skuteczna ochrona przed dezinformacyjnymi treściami generowanymi z wykorzystaniem sztucznej inteligencji wymaga ścisłej synergii między unijnym nadzorem nad globalną infrastrukturą cyfrową a szybką, zindywidualizowaną interwencją procesową przed sądami krajowymi.
This thesis provides a comprehensive analysis of the European Union's regulatory framework governing the phenomenon of deepfakes in the context of contemporary political communication and the protection of the integrity of democratic processes. The first part examines the technological foundations of deepfake technology and the evolution of political communication in the digital environment, thereby illustrating the scale of the threats that artificial intelligence-driven disinformation poses to the integrity of public discourse. The thesis then presents a detailed analysis of the EU legal framework, focusing on the threefold regulatory regime established by the Artificial Intelligence Act, the Digital Services Act, and the General Data Protection Regulation. This analysis identifies the scope and functions of the individual regulatory mechanisms. The final part offers a critical assessment of the effectiveness of these instruments, highlighting the structural lag of EU regulatory procedures behind the pace of technological innovation and contrasting it with the competences of the Member States. On this basis, the thesis concludes that effective protection against AI-generated disinformation requires close synergy between EU oversight of the global digital infrastructure and swift, tailored judicial intervention by national courts.
