The issue of black sites on the example of Poland

Praca ma na celu zbadanie problemu tajnych więzień CIA na przykładzie Polski, z wyszczególnieniem reakcji państwa polskiego i wyciągniętych konsekwencji. Postawiono tezę, według której reakcje państwa polskiego były nieadekwatne do zaistniałej sytuacji oraz nie wyciągnięto odpowiednich konsekwencji personalnych i instytucjonalnych. Praca została podzielona na trzy rozdziały. Rozdział pierwszy prezentuje kontekst międzynarodowy sprawy tajnych więzień CIA. Składa się on z dwóch podrozdziałów – geneza i charakterystyka Programu HVD oraz państwa uczestniczące w Programie HVD. Drugi rozdział skupia się na zaangażowaniu Polski w Program HVD. Podzielony jest na dwa podrozdziały – przebieg Programu HVD w Polsce oraz wyroki ETPC w sprawach al Nashiri i Abu Zubaydah przeciwko Polsce. Rozdział trzeci koncentruje się na reakcji państwa polskiego oraz wyciągniętych konsekwencjach personalnych i instytucjonalnych. Dwa składające się na niego podrozdziały prezentują kolejno śledztwo prokuratury w sprawie tajnych więzień CIA w Polsce i stanowisko polskich władz w sprawie tajnych więzień CIA w Polsce.

The thesis aim is to study the issue of black sites on the example of Poland, detailing the reaction of the Polish state and the consequences drawn. According to the thesis the reactions of the Polish state were inadequate to the situation and no appropriate personal and institutional consequences were drawn. The thesis was divided into three chapters. Chapter one presents the international context of black sites. It consists of two subsections - the origin and characteristics of the HVD Program and the countries participating in the HVD Program. The second chapter focuses on Poland's involvement in the HVD Program. It is divided into two subsections - the course of the HVD Program in Poland and the ECtHR judgments in cases of al Nashiri v. Poland and Abu Zubaydah v. Poland. The third chapter focuses on the reaction of the Polish state and the personal and institutional drawn out consequences. The two subchapters comprising it present, respectively, the prosecutor's investigation of black sites in Poland and the position of the Polish authorities regarding black sites in Poland.
