Direct democracy - the essence of local referendum

Praca licencjacka porusza temat instytucji referendum lokalnego jako jednego z kluczowych instrumentów demokracji bezpośredniej. Praca skupia się na zagadnieniach prawnych referendum lokalnego w Polsce, ale także ujęciu komparatystycznym modelu szwajcarskiego. Celem pracy jest wyjaśnienie jak i w jaki sposób stan prawny oraz nastroje społeczne wpływają na kondycję referendum lokalnego w Polsce. Pierwszy rozdział pracy skupia się na wyjaśnieniu konstytucyjnych gwarancji udziału obywateli w sprawowaniu władzy, analizie ewolucji historycznej i obecnego kształtu ustawy o referendum lokalnym w Polsce. Rozdział drugi poświęcono analizie statystycznej funkcjonowania referendum w polskiej praktyce samorządowej. Szczególną uwagę poświęcono problemowi absencji wyborczej i ważności głosowań, a także specyfice referendów odwoławczych, merytorycznych oraz w sprawie samoopodatkowania się mieszkańców. W trzecim rozdziale przeprowadzono analizę prawno- porównawczą referendum lokalnego w Polsce i w Szwajcarii, omawiając genezę szwajcarskiego modelu demokracji bezpośredniej oraz relacje między organami władzy, a obywatelami. Ukazano w nim ujęcie komparatystyczne procedur referendalnych oraz progów frekwencyjnych, a także zdiagnozowano bariery implementacji wzorców szwajcarskich w polskim samorządzie.

The bachelor's thesis addresses the institution of the local referendum as one of the key instruments of direct democracy. The thesis focuses on the legal aspects of the local referendum in Poland, as well as a comparative approach to the Swiss model. The aim of the thesis is to explain how and in what way the legal status and social attitudes affect the condition f the local referendum in Poland. The first chapter of the thesis focuses on explaining the constitutional guarantees of citizen participation in the exercise of power, analyzing the historical evolution and current framework of the Act on Local Referendum in Poland. The second chapter is dedicated to a statistical analysis of functioning of the referendum in Polish local government practice. Special attention is paid to the problem of voter absenteeism and validity of votes. As well as the specific nature of recall, substantive, and local taxation referendums. The third chapter conducts a legal- comparative analysis of the local referendum in Poland and Switzerland, discussing the origins of the Swiss direct democracy model and relations between authorities and citizens.It presents a comparative approach to referendum procedures and turnout threshold, while diagnostic the barriers to implementing Swiss models in Polish local government.
