The Constitution of 27 February 1938 as a tool for building authoritarianism in Romania

Artykuł dotyczy zmian, które w ustroju politycznym Rumunii wprowadziła konstytucja z 27 lutego 1938 r. Analizę jej tekstu poprzedza wstęp przedstawiający zarys sytuacji politycznej, która doprowadziła do królewskiego zamachu stanu i ogłoszenia nowej konstytucji. Następnie zbadano kierunek przyjętych zmian w odniesieniu do konstytucji z 1923 r. Uwzględniono przede wszystkim artykuły dotyczące praw i obowiązków obywatelskich oraz funkcjonowania władz państwowych. Stwierdzono, że konstytucja z 1938 r. była aktem prawnym, który w Rumunii wprowadził system polityczny o znamionach wyczerpujących defnicję autorytaryzmu.

Te article deals with the changes that the Constitution of 27 February 1938 introduced into Romania’s political system. Te analysis of its text is preceded by an introduction on the outline of the political situation that led to the royal coup and the promulgation of the new constitution. Tis is followed by an analysis of the direction of the changes adopted in relation to the 1923 Constitution. In particular, the articles concerning the rights and duties of citizens and the functioning of state organs were considered. It was concluded that the 1938 Constitution was a piece of legislation that introduced a political system in Romania with characteristics that exhausted the defnition of authoritarianism.
