Procedural solutions in separate proceedings on the example of the procedure in cases of divorce

Praca niniejsza traktuje o postępowaniach odrębnych w kodeksie postępowania cywilnego ma przykładzie postępowania w sprawach o rozwód. W postępowaniach odrębnych należy przestrzegać zasady, że w pierwszej kolejności stosuje się przepisy właściwego postępowania odrębnego, a w razie nieistnienia szczególnych uregulowań – przepisy ogólne o procesie, chyba że kolidują one z przepisami regulującymi postępowanie odrębne (zasada: lex generalis – lex specialis). Zastrzeżenie to oznacza, że w postępowaniu odrębnym ogólne przepisy o procesie mają zastosowanie subsydiarne, przy czym nieraz tylko odpowiednie.Postępowaniami odrębnymi są również postępowania w sprawach małżeńskich w tym postępowanie w sprawach o orzeczenie rozwodu. Szczegółowe rozwiązania tego postępowania i jego specyfika została omówiona w niniejszej pracy. Szczególnie doniosłe rozwiązania dotyczą postępowania dowodowego w tym obligatoryjnego dowodu z przesłuchania stron, współuczestnictwa procesowego, postępowania mediacyjnego, szczególnych zasad reprezentacji, zasad odbywania posiedzeń przy drzwiach zamkniętych, szczególnego trybu zawieszenia postępowania. Rozdział I niniejszej pracy traktuje o pojęciu sprawy cywilnej. W tym rozdziale dokonano ogólnego opisu postępowań kodeksu postępowania cywilnego oraz usystematyzowano poszczególne postępowania odrębne z opisaniem ich charakterystyki. W rozdziale II szczegółowo opisano przesłanki materialne w sprawach o orzeczenie rozwodu zaś w kolejnych rozdziałach omówiono wszczęcie, przebieg i zakończenie samego procesu rozwodowego, ze wskazaniem wszystkich odrębności proceduralnych w zakresie postępowania rozpoznawczego w sprawach o orzeczenie rozwodu a także z omówieniem skutków prawnych wydania wyroku o rozwiązaniu małżeństwa przez rozwód.

This work deals with a separate proceeding in the code of civil procedure is example of conduct in cases of divorce. In chapter II describes in detail the substantive grounds of the judgment of divorce and the following chapters discuss the initiation, conduct and termination of the divorce process itself, with an indication of all the procedural differences with regard to conduct reconnaissance of the judgment of divorce as well as an overview of the legal effects of a judgment of dissolution of marriage by divorce.
