Political freedoms and rights based on the example of the freedom of assemblies. Comparative analysis of national and international regulations.

Prawo do swobody zgromadzania się jest w społeczeństwie demokratycznym prawem fundamentalnym, i tak jak prawo do swobody wypowiedzi, jest jedną z jego podstaw. W pracy przedstawiono problem ochrony wolności zgromadzania się w polskim i międzynarodowym porządku prawnym. Rozdział pierwszy przybliża podstawowe pojęcia, cechy oraz klasyfikację zgromadzeń, a także zakres podmiotowy tej wolności. W rozdziale drugim ukazano konstytucyjne podstawy wolności zgromadzeń w III RP, jej treść, uprawnienia przysługujące jednostce oraz konstytucyjne granice wolności zgromadzania się z przytoczeniem stanowiska Trybunału Konstytucyjnego w tym zakresie. Dalsza część pracy stanowi omówienie ustawy z dnia 5 lipca 1990 r. Prawo o zgromadzeniach oraz uregulowania zawarte w ustawach szczególnych. Przedstawiono ustawowe pojęcie zgromadzenia, zakres podmiotowy, przesłanki dopuszczalności ograniczenia wolności oraz postępowanie w sprawie zgromadzeń. Przytoczono bogate orzecznictwo Trybunału Konstytucyjnego. W kolejnych rozdziałach poruszono problem ochrony wolności zgromadzania się w prawie międzynarodowym z uwzględnieniem orzecznictwa Komitetu Praw Człowieka oraz Europejskiej Komisji Praw Człowieka i Europejskiego Trybunału Praw Człowieka. Ostatni rozdział stanowi próbę analizy wolności zgromadzania się w polskim i międzynarodowym porządku prawnym.

The right to freedom of assembly is a fundamental right in a democratic society and, like the right to freedom of speech, constitutes one of its foundations. The work is focused on problem of protection of the freedom of assembly in both Polish and international law. The first chapter elaborates on the basic concepts, features and classification of assemblies as well as the subjective scope of the said freedom. The second chapter presents the constitutional foundations of the freedom of assemblies in the Third Polish Republic, its content, rights of an individual and constitutional boundaries of the freedom of assemblies along with the description of the Constitutional Tribunal’s standpoint in this field. Further part of the work presents a review of the Public Assembly Act of 5th July 1990 and regulations included in specific acts. The statutory notion of an assembly, the subjective scope, circumstances of acceptability of freedom restrictions and procedure concerning assemblies have been presented. Abundant case-law of the Constitutional Tribunal has been referred to. The next chapters are devoted to protection of the freedom of assemblies in international law taking into consideration the jurisdiction of the Human Rights Committee, the European Commission of Human Rights and the European Tribunal of Human Rights. The last chapter constitutes an attempt to analyze the freedom of assemblies in the Polish and international legal order.
