Program and doctrine of the National Democratic Party of Germany and the freedom of activity of political parties in a democratic state of law

Doktryna i program Narodowodemokratycznej Partii Niemiec (NPD) budzi ogromne kontrowersje. Jej członkowie oskarżani są o neonazizm. W Polsce zasłynęli postulatem rewizji granic. Federalny Trybunał Konstytucyjny dwukrotnie rozstrzygał, czy partia ta powinna zostać zdelegalizowana. Tekst analizuje aktualny program NPD (oraz przykładowe wywiady z aktywistami) pod kątem jego ewentualnej niezgodności ze standardami przyjętymi w państwach demokratycznych. Wskazuje on, że jakkolwiek postulaty te mają charakter nacjonalistyczny, to nie zakładają budowy państwa totalitarnego (a wręcz zakładają wzmocnienie niektórych mechanizmów demokratycznych), a partia nie nawołuje w żaden sposób do pozbawiania kogokolwiek jego elementarnych praw. Reasumując, należałoby przyjąć, że mechanizm delegalizacji partii politycznych powinien być bardzo szczegółowo uregulowany, by demokracja, nawet ta "zdolna do obrony", nie stała się swoim wypaczeniem.

The doctrine and program of the National-Democratic Party of Germany (NPD) makes causes great controversy. Its members are accused of neo-Nazism, in Poland they are commonly known for postulate revision of borders. The Federal Constitutional Court has resolved twice that the party should be banned or not. The text analyzes the current program of NPD (and, for example, interviews with activists) in terms of its possible non-compliance with the standards adopted in democratic countries. It is pointed out that although these demands are nationalistic, they do not assume building a totalitarian state (in some cases they are even the opposite and lead to strengthening democratic mechanisms) and the party does not incite in any way to deprive anyone of his basic rights. In summary, I would assume that the mechanism of closure of political parties should be regulated in more detail to democracy, even "ready to defend", did not become its distortion.
