dc.abstract.enThe main subject of this work are selected problems of applying The Act of 29 January 2004 .Public Procurement Law. The main aim is to present the problems that people applying the Act have to face and to indicate legislative errors that the legislator has made. The work is divided into 4 chapters.The first chapter discusses the problems of applying the Act of 29 January 2004.Public procurement law resulting from the complicated structure of this law. Especially, the characteristics and construction of sources of public procurement law are presented, as well as, the importance of conceptual apparatus for the application of public procurement law and the importance of the correct interpretation of the act to avoid its formalistic application. The second chapter determines the problems arising from the application of the Act of 29 January 2004. Public Procurement Law related to the exemptions included in the Act, problems arising from the reporting obligation in public procurement and the problem of awarding contracts with a value not exceeding EUR 30,000. The third chapter contains the key problems in the application of the Act of 29 January 2004 Public Procurement Law. Public procurement law on the basis of tender proceedings, including the problem of choice of procedure, exclusion of contractors and the problem of subcontracting in public procurement.The last chapter presents the issue of concluding public procurement contracts, pointing to their specificity and limiting the principle of freedom of contract in public procurement. The collateral institution of proper performance of the contract in the manner prescribed by the provisions of the Act of 29 January 2004 was also discussed. Public Procurement Law.pl
dc.abstract.plPrzedmiotem pracy są wybrane problemy stosowania ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych. Głównym celem jest pokazanie problemów z jakimi muszą zmierzyć się osoby stosujące przedmiotową ustawę oraz wskazanie błędów legislacyjnych, które popełnił ustawodawca. Praca podzielona jest na 4 rozdziały. W rozdziale pierwszym omówione zostałyproblemy stosowania ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych wynikające ze skomplikowanej struktury tego prawa. W szczególności przedstawiona jestcharakterystyka i budowa źródeł prawa zamówień publicznych, znaczenie aparatury pojęciowej dla stosowania prawa zamówień publicznych oraz znaczenie prawidłowej wykładni ustawy dla uniknięcia jej formalistycznego stosowania. Rozdział drugi określa problemy wynikające ze stosowania ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych związane z wyłączeniami przewidzianymi w ustawie, problemy wynikające z obowiązku sprawozdawczego w zamówieniach publicznych oraz problem udzielania zamówień o wartości nieprzekraczającej 30 tysięcy euro.W rozdziale trzecim zawarte zostały kluczowe problemy stosowania ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych na gruncie postępowania przetargowego w tymproblem wyboru procedury, wykluczenia wykonawców oraz problem podwykonawstwa w zamówieniach publicznych. Ostatni rozdział przedstawia problematykę zawierania umów w sprawie zamówienia publicznego wskazując na ich specyfikę oraz ograniczenie zasady swobody umów w zamówieniach publicznych . Omówiona została także instytucja zabezpieczenia należytego wykonania umowy w sposób nakazany przepisami ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych.pl
