Głównym celem przedmiotowej pracy jest przedstawienie instytucji wadium jako ważnego elementu w prawie zamówień publicznych. Niniejsza praca opisuje na przykładzie przetargu nieograniczonego przebieg postępowania o udzielenie zamówienia publicznego od momentu ogłoszenia postępowania do momentu zawarcia umowy.W pierwszym rozdziale pracy możemy dowiedzieć się czym jest samo zamówienie publiczne, kto i kiedy zobowiązany jest do jego udzielania oraz jakie są prawidłowe sposoby zabezpieczenia zawarcia i należytego wykonania umowy. Także w tym rozdziale porównano wadium z innymi formami zabezpieczenia zawarcia umowy stosowanymi w prawie polskim.W rozdziale drugim opisane zostały zasady ustalania wadium. Dowiemy się tutaj o tym czym jest dla wykonawców wadium i jakie niesie za sobą obowiązki. Jakie są rodzaje wadium oraz kto jest uprawniony do wyboru formy wadium. A także kto i na jakich zasadach ustala wysokość oraz termin złożenia wadium.W trzecim rozdziale opisane zostały rzeczy budzące największe wątpliwości wśród wykonawców, a mianowicie zwrot i zatrzymanie przez zamawiającego wadium złożonego w postępowaniu o udzielenie zamówienia publicznego oraz związane z tym spory.

The main objective goal of this work is to introduce the tender guarantee institution as an important element in public procurement. This study describes the procedure of public procurement on the example of competitive bidding process beginning from the moment of announcing the process until the moment of signing the contract.In the first chapter of the objective research it can be learnt what the public procurement is, who and when the responsible is and what the appropriate ways of performance bond are. In this chapter also tender guarantee and other forms of security deposit used in Polish law.In the second chapter the rules of establishing the tender guarantee are described. It is learnt what the tender guarantee for contractors is and what the responsibilities are. What the types of the tender guarantee are and who is empowered for the choice of the form of tender guarantee. And also who and on what terms establishes the size and the date of the tender guarantee submission.In the third chapter the most disputable matters among the contractors were described, namely the return and keeping the tender guarantee by the ordering party, submitted in the public procurement procedure and the arguments connected.
